GENERAL
1. These Terms and Conditions (Terms) relate to the ‘SEMCO Diesel, Dirt & Turf 2025 Takeuchi Giveaway’ promotion (the Promotion).
2. Information on how to enter and prize information form part of these Terms and Conditions of entry (Conditions of Entry).
3. Entry into this Promotion is deemed acceptance of these Conditions of Entry.
4. The entrant is responsible for familiarising themselves with the Conditions of Entry at the time of participation. The Promoter’s decision not to enforce a specific restriction (whether communicated to an entrant or not) does not constitute a waiver of that restriction or the Conditions of Entry generally.
5. The Promoter may rely on these Conditions of Entry even if it learns of an entrant’s ineligibility after awarding a prize. The prize may be recovered or equivalent value reimbursed in such cases.
6. The Promoter’s decision in relation to any aspect of these Conditions of Entry and the Promotion is final and binding on all entrants. No correspondence will be entered into. This does not affect an entrant’s rights under the Australian Consumer Law.

PROMOTION PERIOD
8. The Promotion commences at 9:30am (AEST) on Friday, 16 May 2025 and closes at 3:00pm (AEST) on Sunday, 18 May 2025.

ELIGIBILITY
9. Entry is open to Australian residents who hold a valid Australian Business Number (ABN).
10. This Promotion is only open to residents of NSW, VIC, QLD, TAS, and ACT.
11. Residents of SA, NT, and WA are not eligible to enter.
12. Entrants must attend the Diesel, Dirt & Turf Expo 2025 and visit the SEMCO stand or participating partner stands to enter.
13. Entry is free of charge. No purchase or subscription is required.

HOW TO ENTER
14. Eligible Entrants must, during the Promotion Period:

a. Visit the SEMCO stand or participating partner stands;
b. Scan the QR code located at the stand;
c. Complete and submit the online entry form with valid details, including ABN.

15. Only one (1) entry per ABN is permitted.
16. Entries are deemed received when entered the Promoter’s database, not when transmitted.

PRIZE DETAILS, DRAW, AND WINNER NOTIFICATION

17. One (1) prize will be awarded: a prize package valued at $70,000 AUD, comprising:

• Takeuchi TB215R
• Twin-lock hydraulic hitch (Elite Attachments)
• 5-finger hydraulic grab (Norm Engineering)
• PDX-2 auger drive with two tungsten auger bits (Digga)
• Sureweld 2.5-tonne aluminium trailer
• Pre-delivery provided by SEMCO.

18. The prize is not transferable or redeemable for cash.

DRAW & ANNOUNCEMENT
19. The Prize draw will occur at the SEMCO Toro stand (#B5) on Sunday, 18 May 2025 between 4:00pm – 5:00pm AEST. The draw will be conducted using the Electronic Drawing System by Trade Promotions and Lotteries Pty Ltd (ACN 601 297 330), Approval No: 1224.
20. The winner does not need to be present at the draw. The first valid entry drawn will be the winner. The winner will be notified by phone and email by 5:00pm AEST on Monday, 19 May 2025. The Prize is not redeemable for cash, exchange or resale.

GENERAL CONDITIONS
22. SEMCO reserves the right to verify the validity of entries and ABNs.
23. By entering, participants agree to the use of their name and image for promotional purposes if they are selected as the winner.
24. The Promoter is not responsible for entries not received or late due to technical failure or other reasons beyond its control.
25. The winner is responsible for any incidental costs associated with the Prize.
Any entrant found to have tampered with the entry process or acted improperly may be disqualified. The Promoter may seek compensation for any damage or cost resulting from a breach.
26. To the extent permitted by law, the Promoter and associated parties are not liable for any injury, loss or damage arising in connection with the Promotion or Prize, except where liability cannot be excluded by law.
27. The winner is responsible for any tax implications arising from receiving the Prize. Independent financial advice is recommended.
28. The winner agrees to participate in reasonable promotional activity and allows use of their name and image for promotional purposes, free of charge.
29. Deliberate interference with the Promotion may result in legal action

30. All personal information collected will be handled in accordance with SEMCO’s Privacy Policy and will be used solely for the purposes of administering this promotion.
