SEMCO DIESEL, DIRT & TURF 2025 TORO GIVEAWAY – TERMS & CONDITIONS

GENERAL
1. These Terms and Conditions (Terms) relate to the ‘SEMCO Diesel, Dirt & Turf 2025 Toro Giveaway’ promotion (the Promotion).
2. Information on how to enter and prize information form part of these Terms and Conditions of entry (Conditions of Entry).
3. Entry into this Promotion is deemed acceptance of these Conditions of Entry.
4. The entrant is responsible for familiarising themselves with the Conditions of Entry at the time of participation. The Promoter’s decision not to enforce a specific restriction (whether communicated to an entrant or not) does not constitute a waiver of that restriction or the Conditions of Entry generally.
5. The Promoter may rely on these Conditions of Entry even if it learns of an entrant’s ineligibility after awarding a prize. The prize may be recovered or equivalent value reimbursed in such cases.
6. The Promoter’s decision in relation to any aspect of these Conditions of Entry and the Promotion is final and binding on all entrants. No correspondence will be entered into. This does not affect an entrant’s rights under the Australian Consumer Law.

PROMOTION PERIOD
8. The Promotion commences at 9:30am (AEST) on Friday, 16 May 2025 and closes at 3:00pm (AEST) on Sunday, 18 May 2025.

ELIGIBILITY
9. Entry is open to Australian residents aged 18 years and over who remain Australian residents for the duration of the Promotion, excluding:
a. Management, employees, directors and contractors of the Promoter, exhibitors and contractors working for exhibitors at the Diesel, Dirt & Turf Expo 2025, its related entities, bodies corporate, and agencies involved with the Promotion (including the prize supplier);
b. Immediate family members (spouse, ex-spouse, de facto spouse, parent, stepparent, grandparent, guardian, uncle, aunt, niece, nephew, sibling, stepsibling, child or stepchild) of those listed in 9(a);
c. Residents of South Australia (SA) and Northern Territory (NT), due to state permit requirements, and Western Australia (WA);
d. Persons who have previously breached the terms of any promotion conducted by the Promoter.
10. An ABN is not required to enter.
11. Entrants must physically attend the Diesel, Dirt & Turf Expo 2025 between 16–18 May 2025 and visit the SEMCO Toro stand (#H1) to enter.
12. Entry is free. No purchase or subscription is required.

HOW TO ENTER
13. Eligible Entrants must, during the Promotion Period:
a. Attend the Diesel, Dirt & Turf Expo 2025 and visit the SEMCO Toro stand (#H1);
b. Scan the QR code located at the stand;
c. Complete and submit the online entry form, providing:
i. First name, last name, email address, mobile number and postcode;
ii. Acceptance of these Terms and Conditions.
14. One entry per person only. Duplicate entries with the same name, email or phone number will be disqualified.
15. Entries are deemed received at the time they enter the Promoter’s database, not when sent by the entrant.

VERIFICATION
16. The Promoter may require entrants to provide:
a. Valid photo ID or documentation confirming eligibility (age, residency, identity);
b. Information in person or via a reasonable method as requested by the Promoter.
17. If verification is not completed to the Promoter’s satisfaction, the entry will be deemed invalid.
18. The Prize will only be awarded after the winner has passed all validation requirements.

PRIZE DETAILS, DRAW, AND WINNER NOTIFICATION
19. One (1) Prize will be awarded: a Toro eS3000SD Battery Powered Ride-on Mower (Model No. 75500) valued at $4,999 AUD.
20. The Promoter will cover delivery and pre-delivery inspection of the Prize.
21. The Prize draw will occur at the SEMCO Toro stand (#H1) on Sunday, 18 May 2025 between 3:00pm – 4:00pm AEST. The draw will be conducted using the Electronic Drawing System by Trade Promotions and Lotteries Pty Ltd (ACN 601 297 330), Approval No: 1224.
22. The winner does not need to be present at the draw. The first valid entry drawn will be the winner. The winner will be notified by phone and email by 5:00pm AEST on Monday, 19 May 2025. The Prize is not redeemable for cash, exchange or resale.
23. The Prize will be delivered to the winner within 30 business days from 19 May 2025.

UNCLAIMED PRIZE RE-DRAW
24. If the Prize is unclaimed after 90 days or returned to the Promoter, a redraw will occur at 10:00am (AEST) on Monday, 18 August 2025 at 55–63 Kurrajong Rd, North St Marys, NSW, 2760. The winner will be notified by phone and email the same day.
25. The winner’s first initial, last name, and postcode will be published on the entry page and Semco’s official Facebook page within 30 days of the draw.

GENERAL CONDITIONS
26. The Promoter is not responsible for entries not received or late due to technical failure or other reasons beyond its control.
27. The winner is responsible for any incidental costs associated with the Prize.
28. Any entrant found to have tampered with the entry process or acted improperly may be disqualified. The Promoter may seek compensation for any damage or cost resulting from a breach.
29. To the extent permitted by law, the Promoter and associated parties are not liable for any injury, loss or damage arising in connection with the Promotion or Prize, except where liability cannot be excluded by law.
30. The winner is responsible for any tax implications arising from receiving the Prize. Independent financial advice is recommended.
31. The winner agrees to participate in reasonable promotional activity and allows use of their name and image for promotional purposes, free of charge.
32. Deliberate interference with the Promotion may result in legal action.

INTELLECTUAL PROPERTY & PRIVACY
33. All Intellectual Property Rights associated with entries become the property of the Promoter upon submission.
34. Participation does not grant any rights in the Promoter’s trademarks or branding.
35. Personal information will be used solely for administering this Promotion.

LIABILITY & FORCE MAJEURE
36. Nothing in these Terms limits your rights under the Australian Consumer Law or other similar laws.
37. If the Promotion cannot run as planned due to events beyond the Promoter’s control (e.g. natural disasters, technical failures), the Promoter may suspend, cancel or amend the Promotion, subject to applicable laws.

PRIVACY
38. The Promoter collects personal information to run the Promotion and may disclose it to third parties (e.g. prize suppliers, agents) or regulatory authorities.

40. The Privacy Policy contains information on how to lodge a complaint.
41. The Promoter complies with the Australian Privacy Principles under the Privacy Act 1988.
